Iwatani America Accuses Nel of Norway about H2 Station
According to some media of US, Iwatani of America (locally incorporated by Iwatani) accused Nel ASA a Norwegian manufacturer and its subsidiaries of water electrolysis equipment to the District Court of California on the grounds of causing the damages recognized with the 11 complaints which were attributed to Nel’s concealing of defect, misrepresentation and contract fraud relating to the hydrogen supplying equipment (product name:H2 Station) for hydrogen stations which Iwatani purchased. Nel denies the allegation and takes all-out fighting attitude.
According to the media, Iwatani of America bought seven H2 stations from Nel and was using them for its hydrogen stations in California. However, no prior field test had been made by Nel before the delivery, and actually the use of the products by Iwatani America played the role of field test instead.
It had been so designed that the operating condition of each equipment could be comprehended only by Nel using its monitoring system. In addition, the control system and software had not been completed and it is reported that the codes were put in by Nel using its remote operation after the delivery. Such means taken by Nel compelled Iwatani America to bear the cost for field testing, establishing the control system and software.
Apart from the insisting, Iwatani America pointed out and described the following cases:
1) Nel misrepresented the business record of its products before concluding the agreement and also hided the fact that it caused damages to customers amounting to several million dollars due to the defects and troubles caused by Nel.
2) Just a simple mother manual was given, which disabled the operators to recognize any error code.
3) There occurred a machine trouble of diaphragm compressor of H2 station in Hawaiian Garden, which made the station out of operation for one week.
4) At least 85 pieces of valve were out of order at two stations.
5) Test operations of H2 station were much delayed in Seal Beach, Anaheim, Santa Ana and La Mirada causing damages in the business.
For information, Iwatani of America has not disclosed the total amount of damages. In response to our request to confirm the facts, Human Relations Dept. of Iwatani Corporation refrained from comment because of being in dispute.
