On December 19, 2013 Air Water (AWI) brought to the Tokyo High Court for cancellation of deliberation appealing against the trial decision of the Fair Trade Commission on November 19 of the same year. On September 26 the Tokyo High Court adjudged to permit AWI’s request for revocation.

On May 26, 2011 AWI appealed to the Fair Trade Commission against the unacceptable standard for the surcharge calculation shown in the Cease and Desist Order and Surcharge Payment Order on the antitrust case concerning the air gas price by the 4 industrial gas producers. The appeal was rejected on November 19 of last year and therefore AWI has been appealing to the Tokyo High Court since then.

Following the court decision, the Fair Trade Commission is to decide within 2 weeks whether it appeals to the Supreme Court or not.
